Enduring Powers of Attorney

The Mental Capacity Act 2005 eventually becomes effective from 1st October 2007. After that date, the current simple process of preparing an Enduring Power of Attorney will be replaced by a more comprehensive but complicated and expensive procedure.
Currently you can appoint one or more Attorneys to act on your behalf. It can be used for a variety of reasons not least in the event you become mentally incapable or for some other reason as to why you cannot manage your financial affairs.
If you are thinking about appointing an Enduring Power of Attorney, you should do so before 1st October 2007.
