New Powers of Attorney
From 1st October 2007, there is a new framework for the way decisons are made for persons lacking mental capacity relating to property and personal welfare.
Whilst existing Enduring Powers of Attorney made before that date remain valid, you must now consider whether you wish to enter into a Lasting Power of Attorney, which only deals with property and affairs and/or a Lasting Power of Attorney which gives welfare and healthcare decision making powers to your attorney.
The new rules and forms are longer and more detailed and it is imperative that you understand them.
