Landlord and Tenant – The Benefit Cap

Bedroom tax has not to date had a direct effect on private sector tenants. However, from the end of September 2013 all local councils will have applied the benefit cap. This is likely to result in many cases in tenants not paying their rent and leaving landlords with no option but to evict them.
It is vital that the Landlord follows the correct procedure for eviction to include correct notice of service. Further since April 2007 all deposits must be protected in one of the government deposit schemes and failure to do this may result in a penalty for the landlord and also risks their eviction claim being dismissed.
