Business to Business Debt Recovery

We understand the implications that a debt can have on any business, large or small, and know how time-consuming it can be to chase late payments. Carr & Co routinely act for small and mid-sized businesses to assist with the recovery of commercial debts.

We offer a fast and efficient service, guiding you through the process from pre-action correspondence to legal action and enforcement.

If the debt is not disputed and enforcement action is not needed, we would normally operate on a fixed fee basis.

If the other party disputes your claim at any point, we will discuss any further work required and provide you with revised advice about our costs.

Anticipated charges and expenses for undisputed debt recovery are:

£5,001 – £10,000	£455.00	£900.00 to £1,200.00	£1,355.00 – £1,655.00
£10,001 – £100,000	5% value of the claim	£1,200.00 to £6,000.00	£1,200.00 to £6,000.00 plus 5% court fee

These fees include:

Taking instruction and reviewing documentation
Undertaking appropriate searches
Sending a formal Letter before Action
Receiving payment and sending on to you, or, if the debt is not paid, drafting and issuing a claim
Where no response is received, applying to the Court to enter Judgement in Default
When Judge in Default is received, writing to the other side to request payment

Anyone wishing to proceed with a claim should note that:

The VAT element of our fee cannot be reclaimed from your debtor
Interest on the debt may take the debt into higher banding with a higher cost
The costs quoted above are not for matters where enforcement action is needed to collect the debt (such as instructing a debt recovery agent)
Matters will usually take between 8 to 12 weeks from receipt of your instructions to payment, provided it is relatively straightforward, and the debtor does not dispute the matter. If it becomes necessary to issue proceedings and/or enforcement action is needed, it will take longer to resolve
If at any point we are instructed to carry out work outside of the standard debt recovery structure detailed above, our charges will be based on the time spent on the matter. Our current hourly charging rates are as follows:
